The following is what I did but wasted a lot of time and MONEY by not establishing my "Court of Record at Common Law" and really is not worth the time to review but wanted to share just as an education.

I sent to then U.S. Attorney General Ashcroft dated March 7, 2003 as well as the supporting 300-plus pages of evidence that are below in the exhibits.  This letter was also sent to then President Bush Jr, FBI, U.S. Marshals, numerous other elected and appointed officials all listed on the last page of the letter.

Conflict of Interest Court Order 11-20-2007 was awarded to me when I had to represent myself because my then Attorney Papa did not think there was a conflict of interest of Attorney Chivers hiring Attorney Brewer to represent him when Brewer shared a law office with Attorney Murtagh (see details in COMPLAINT above). Sad that a non-attorney like me wins a case that an attorney would not file!

Notice of recording of NON PROS 8-14-19 sent to me (Joe Myers) from the Butler County Prothonotary's Office stating that a judgement of NON PROS was entered against me which is unconstitutional as Defendant Chivers CANNOT make any pleading to the court without a JURY.

U.S. Representative Kelly is a letter dated 8-21-19 that I (Joe Myers) sent to Representative Kelly from my home town of Butler making him aware of the corruption and for him to start a Congressional Hearing.  

Response from OAG Civil Rights Division 8-22-19 after receiving this response from the Office of United States Attorney General Civil Rights Division I (Joe Myers) called on 9-18-19 and spoke with Civil Investigator Lisa Allen who sent me the letter. I informed her that you have all the evidence you need from the letter I sent to then U.S. Attorney Ashcroft to prosecute those at the local, state and federal level. She asked for my phone number and informed me she was forwarding my case to her supervisor and he would be calling me.

Butler County Courthouse Scheduling Order dated 9-9-19 is a Scheduling Order I (Joe Myers) received stating that ALL the judges of Butler County Court of Common Pleas recused themselves and the order stated in the footer "...this Court was assigned to preside in this matter by the Supreme Court of Pennsylvania." It does not say WHAT COURT! I then called on 9-18-19 and informed Butler County Court Administrator Candace Graff that I explained in my initial Complaint and all subsequent pleadings I WILL NOT allow one judge and a bunch of corrupt attorneys to violate my United States and Pennsylvania Constitutional RIGHT to be heard by a JURY OF MY PEERS that has already happened in the past by corrupt judges! I informed Ms. Graff I will be submitting a pleading stating that this Scheduling Order is once again a violation of my United States and Pennsylvania Constitutional RIGHT to be heard by a JURY OF MY PEERS that has already happened in the past! All the defendants will have the opportunity to make their case before the JURY just like me AND NOT just before William Cunningham who is listed on the Scheduling Order. 

Response to Butler County Courthouse Scheduling Order is dated 9-19-19. This is the response I (Joe Myers) sent to the court stating there could be no oral arguments or ANY proceedings without me or the JURY present so the JURY could rule on ALL the evidence. Additionally I asserted that once I DEMANDED a JURY TRIAL this court has to honor my RIGHTS under the United States Constitution and Pennsylvania Constitution. I further explained that if the court does not set a date for a JURY selection and JURY TRIAL then that is OBSTRUCTION JUSTICE.

Email from Senator Rubio 9-23-19 was sent to me (Joe Myers) stating Mr. Rubio regretted the problems I was having with the U.S. Department of Justice and his office has made a congressional inquiry to the U.S. Department of Justice.

Email from Congressman Rutherford's office 9-24-19 was sent to me (Joe Myers) from Momi Malspeis the Director of Constituent Services after our phone conversation today. Ms. Malspeis stated in her email she would be contacting Senator Rubio's office to inform Rubio that Congressman Rutherford is supporting the congressional inquiry.

Praecipe For Appearance dated 9-24-19 submitted by Defendants Murtagh, Nanni, Leyland, Gallagher, Loverick, Lewis and UAW (formerly Butler Armco Independent Union) alleged legal counsel Adam Hobaugh. Murtagh, Hobaugh and UAW would send back my court filings stating Murtagh was not there. Kind of odd how Hobaugh is now the alleged legal counsel for the aforementioned Defendants.

Meeting 10-9-10 I (Joe Myers) met with Congressman Rutherford at his office in Jacksonville Florida. He was very prepared because of the questions he asked and I knew he had reviewed this website and the main information. I explained to him that DC has become organized crime after I detailed all the evidence and NOTHING WAS DONE BY THOSE IN DC that received my letter in 2003. He stated he was going to be contacting Senator Rubio to be part of the congressional inquiry. After explaining the corruption I have dealt with in the Butler County Courthouse of being denied my Constitutional Right to a trail by jury I mentioned how the current judge is moving forward with a preliminary objections hearing even after I informed the judge I do not want this case tried by one judge but only BEFORE A JURY OF MY PEERS! He asked me to let him know what the outcome of the hearing is on 10-22-19.

Limited Special Appearance Preliminary Objections 10-18-19 is a court filing by Defendant Papa trying to intimidate me (Joe Myers) by submitting a court filing that violates my Constitutional Rights of the United States of America. 

Email from Senator Rubio 10-24-19 was sent to me (Joe Myers) stating Mr. Rubio has not received a reply yet from the U.S. Department of Justice but he assured me that his office will continue to monitor my case and keep me informed throughout the process.

Amended Court Filing Adding Defendants 10-28-19 court filing by me (Joe Myers) adding the judge and Defendants legal counsel as defendants for violating my Constitutional Rights of the United States of America as well as many other violations. This court filing addresses Defendant Papa's Limited Special Appearance Preliminary Objections 10-18-19. The judge and all the Defendants with law license know they have violated their sworn oath the uphold the Constitution of the United States of America and they have violated their oath by committing malice against me.

42 Pennsylvania Consolidated Statutes § 2522 - Oath Of Office § 2522. Oath of office.
 
Before entering upon the duties of his office, each attorney at law shall take and subscribe the following oath or affirmation before a person authorized to administer oaths:
 
"I do solemnly swear (or affirm) that I will support, obey and defend the Constitution of the United States and the Constitution of this Commonwealth and that I will discharge the duties of my office with fidelity, as well to the court as to the client, that I will use no falsehood, nor delay the cause of any person for lucre or malice."
 
Any person refusing to take the oath or affirmation shall forfeit his office.

Letter to PA Attorney General Josh Shapiro 10-29-19 was sent by me (Joe Myers) to inquire about the Complaint I filed online with Shapiro's office PA Attorney General Complaint 8-9-19. Additionally with the letter I sent to then U.S. Attorney General Ashcroft dated March 7, 2003 as well as the initial Complaint I filled on 5-29-19, the court filing Legal Notice and Warning for Violation of Right Under Color of Law 10-16-19, the court filing Amended Legal Notice and Warning for Violation of Right Under Color of Law 10-18-19, and the most recent court filing of Amended Court Filing Adding Defendants 10-28-19. I explained while I was not holding him accountable for the lack of justice prior PA Attorney General Mike Fisher but I was exposing him now to the continued violation of my Constitutional Rights of the United States of America so the ball is in his court as to whether Mr. Shapiro is going to prosecute the Defendants and everyone complicit to this corruption against me at the local and state level. The Defendants and the so-called Judge Cunningham were saying I am time barred with a 2 year statute of limitations (which is unconstitutional) when IN FACT I sent the letter to then U.S. Attorney General Ashcroft on March 7, 2003 seeking justice from the corruption CLEARLY within the 2 years from the day I was escorted out of Defendant AK Steel's Butler plant on March 23, 2001.

Supplement to Brief in Support Of Preliminary Objections 10-31-19 was submitted by Defendant Hobaugh. This court filing substantiates the continued violation of my (Joe Myers) U.S. CONSTITUTIONAL and PENNSYLVANIA CONSTITUTIONAL RIGHTS to a TRAIL BY JURY, DUE PROCESS and EQUAL PROTECTION OF THE LAWS. What ALL Defendants are trying do is apply PRETENDED LEGISLATION to illegally protect them and are saying MY RIGHTS mean nothing! This whole issue started when Defendant AK Steel committed a CRIME by firing me for WHISTLE BLOWING and every Defendant has been complicit in the crime!

Response to Supplement to Brief in Support Of Preliminary Objections 11-5-19 was submitted by me (Joe Myers). In this court filing I detailed how Defendant Cunningham who WAS the judge and ALL other Defendants have continued to VIOLATE the CONSTITUTION OF THE UNITED STATES OF AMERICA by trying to apply PRETENDED LEGISLATION. I provide a CIVICS LESSON in this court filing from the Declaration of Independence and OUR Constitution that EVERYONE is bound to obey and is the RULE OF LAW!  

Our Representatives that signed the Declaration of Independence explained the grievances they had against King George and some of the following are what ALL Defendants are VIOLATING now that our Representatives rescued us from and I AM NOT GIVING THOSE RIGHTS UP!

• "For depriving us in many cases, of the benefits of Trial by Jury"
• "He has combined with others to subject us to a jurisdiction foreign to our constitution, and unacknowledged by our laws; giving his Assent to their Acts of pretended Legislation" (Emphasis added)
• "For transporting us beyond Seas to be tried for pretended offences" (Emphasis added)

CRIME "A crime is a wrongdoing classified by the state or Congress as a felony or misdemeanor. A crime is an offense against public law." 

All Defendants committed a crime when they violated my Constitutional Rights. Defendant Cunningham stated in the UNCONSTITUTIONAL preliminary objections hearing on 10-22-19 that "Just because you asked for a jury trial does not mean you can have one." which violates the Constitution of the United States of America Amendment 7 - Trial by Jury in Civil Cases. Ratified 12/15/1791:

• "In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re- examined in any Court of the United States, than according to the rules of the common law." (Emphasis added)

​The Constitution of the Commonwealth of Pennsylvania Declaration of Rights Section 6 upholds the Constitution of the United States of America: 

• "Trial by jury shall be as heretofore, and the right thereof remain inviolate. The General assembly may provide, however, by law, that a verdict may be rendered by not less than five-sixths of the jury in any civil case. Furthermore, in criminal cases, the Commonwealth shall have the same right to trial by jury as does the accused." (Emphasis added)

Criminal Defendant Cunningham additionally violated the Constitution of the United States of America Article. VI. - Debts, Supremacy, Oaths:

• ​"This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding." (Emphasis added)

Criminal Defendant Cunningham also violated the Constitution of the United States of America Amendment 9 - Construction of Constitution. Ratified 12/15/1791.

• ​"The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people." (Emphasis added)

In addition Criminal Defendant Cunningham violated Amendment 14 - Citizenship Rights. Ratified 7/9/1868.

• "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws." (Emphasis added)

This proves Criminal Defendant Cunningham violated his sworn oath as a "so-called" judge to PROTECT MY RIGHTS!!! 

All Defendants and their Defendant legal counsels have been complicit in the criminal activity of VIOLATING MY CONSTITUTIONAL RIGHTS and LAWS THAT PROTECT WE THE PEOPLE!!!

Email to Senator Rubio's office 11-14-19 was sent from me (Joe Myers) after my conversation with Natalie from Senator Rubio's office on 11-14-19. As I explained the continued corruption in the Butler County Courts against me I informed her I added the judge and Defendants legal counsel as Defendants as well. I also informed her of the Violation Warnings for Denial of Rights Under Color of Law that are now part of the court records and she requested that I send her my latest court filings and she would forward them to the United States Department of Justice and the FBI. I also copied Congressman Rutherford on this email since he is part of the congressional inquiry as well.

Email to Butler County Commissioners 11-15-19 was sent from me (Joe Myers) to put Butler County Commissioners Ms. Osche, Ms. Geyer and Mr. Boozel on notice that I have every intent to hold Butler County liable for the violation of my Constitutional Rights of the United States of America. I provided the content of the email that I sent to Senator Rubio's office on 11-14-19 as well as the recent court filings. I informed the Commissioners of the congressional inquiry initiated by Senator Rubio and that his office is forwarding my recent court filings to the U.S. Department of Justice and the FBI. I also informed the Commissioners I have contacted the Mayor of the City of Butler and the Butler County District Attorney and have had NO REPLY!

Motion to Strike was filed by Defendant Koch dated 11-18-19 again trying to violate my (Joe Myers) Constitutional Rights of the United States of America. The criminality of ALL Defendants is a sad day for our country!

Response to Motion to Strike filed on 11-25-19 by me (Joe Myers) that details the corruption from all the Defendants and their BLATANT disregard to the Constitution of the United States of America and my Constitutional Rights.

Fraudulent Court Document was UNCONSTITIONALLY filed on 11-21-19 by Defendant Cunningham and is UNLAWFUL and a CRIME at the highest level as he was named as a DEFENDANT in my (Joe Myers) Amended Court Filing Adding Defendants 10-28-19! It is a conflict of interest for Cunningham to make a court ruling when he is a NAMED Defendant! The corruption in Butler County never ceases!!! The appeal by me (Joe Myers) will be filed with the PA Supreme Court seeking disbarment of ALL Defendants with a law license and punitive and compensatory damages against ALL Defendants.

Email from Senator Rubio 12-12-19 was sent to me (Joe Myers) stating Mr. Rubio has not received a reply yet from the U.S. Department of Justice but he assured me that his office will continue to monitor my case and keep me informed throughout the process.

Notice of Appeal was filed with the Pennsylvania Supreme Court by me (Joe Myers) to Appeal the corruption in the Butler County court system and the illegal ruling by Defendant Cunningham. This court filing details with EVIDENCE the FRAUD by ALL Defendants involved.

Email to Senator Rubio 12-19-19 sent from me (Joe Myers) to Senator Rubio detailing the continued corruption in my case. I provided the Notice of Appeal I filed yesterday and asked that the court filing be forwarded to the U.S. Department of Justice and the FBI as he has everything else I have provided him.

Email to Congressman Rutherford 12-19-19 sent from me (Joe Myers) to Congressman Rutherford per his request to keep him updated as to my court case in Pennsylvania. I also provided the Notice of Appeal I filed yesterday.

Supreme Court of Pennsylvania Order was a correspondence mailed to me (Joe Myers) stating the ORDER regarding my Notice of Appeal ​to be transferred to the Superior Court. Title 42 § 722 (3).  Direct appeals from courts of common pleas.

"The Supreme Court shall have exclusive jurisdiction of appeals from final orders of the courts of common pleas in the following classes of cases:

(3)  Matters where the qualifications, tenure or right to serve, or the manner of service, of any member of the judiciary is drawn in question."

Justice Bandeis eloquently affirmed his condemnation of abuses practiced by Government officials in the case of Olmstead vs. U.S. 277 US 438, 48 S.Ct. 564, 575; 72 L ED 944 (1928) he declared:
 
"Decency, security, and liberty alike demand that Government officials shall be subjected to the same rules of conduct that are commands to the Citizen. In a Government of laws, existence of the Government will be imperiled if it fails to observe the law scrupulously. Our Government is the potent, the omnipresent teacher.

If the Government becomes a law-breaker, it breads contempt for law; it invites every man to become a law unto himself. It invites anarchy. To declare that, in the administration of the law, the end justifies the means would bring a terrible retribution. Against that pernicious doctrine, this Court should resolutely set its face."

Below is the information I made as part of my Briefing for the Court:

All the FOUNDING DOCUMENTS of our country are SUCCESSIVE and build upon each other to make sure that INDIVIDUAL RIGHTS are protected and establish those RIGHTS that are given by our Creator and no government officials can give RIGHTS or take RIGHTS away.

The Declaration of Independence declares our God given RIGHTS and the usurpation's of King George violated those RIGHTS and the following are some specific usurpation's:

• He has refused his Assent to Laws, the most wholesome and necessary for the public good
• He has made Judges dependent on his Will alone
• For depriving us in many cases, of the benefits of Trial by Jury 
• Abolishing our most valuable Laws, and altering fundamentally the Forms of our Governments
• For suspending our own Legislatures, and declaring themselves invested with power to legislate for us in all cases whatsoever

Our representatives that signed the Declaration of Independence declared the following:

“In every stage of these Oppressions We have Petitioned for Redress in the most humble terms: Our repeated Petitions have been answered only by repeated injury. A Prince whose character is thus marked by every act which may define a Tyrant, is unfit to be the ruler of a free people.
Nor have We been wanting in attentions to our Brittish brethren. We have warned them from time to time of attempts by their legislature to extend an unwarrantable jurisdiction over us. We have reminded them of the circumstances of our emigration and settlement here.”

The Constitution establishes and mandates the framework and restrictions of the federal and state government elected and appointed positions.
The Preamble to the Constitution establishes We The People ordain and establish the Constitution which clearly states the People are the ultimate authority. The Preamble to the Bill of Rights mandates more declaratory and restrictive clauses by ratifying the first 10 Amendments.

“The Conventions of a number of the States, having at the time of their adopting the Constitution expressed a desire in order to prevent misconstruction or abuse of its powers, that further declaratory and restrictive clauses should be added: And as extending the ground of public confidence in the Government will best ensure the beneficent ends of its institution.” Bill of Rights PREAMBLE (Emphasis added) 

The 14th Amendment ratified some 70 years later further restricts the states by declaring:

 “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”

There is no statute of limitations that can be applied to impede me from recovering punitive and compensatory damages because the SUCCESSIVE Founding Documents validate I have RIGHTS that NO COURT can give or take those RIGHTS away. The 14th Amendment validates the State cannot deprive me of my PROPERTY (labor).

Unconstitutional Non-Precedential Decision dated 6-25-20 was sent to me (Joe Myers) by the Superior Court of Pennsylvania. The UNCONSTITUTIONAL Decision flies in the face of the Constitution of the United States of America and the Pennsylvania Constitution. The Superior Court judges that filed the Decision know that rules of procedure of the courts can only be corrected but rules can NEVER supersede SUBSTANTIVE LAW which is the Constitution of the United States of America and the Pennsylvania Constitution.

It is very clear the rules that the judges are attempting to use have abridged my Constitutional Substantive Rights!

Appellant's Demur To Non-Precedential Decision and WARNING to the COURT 7-2-20 was filed by me (Joe Myers) WARNING the Court and the judges that if they do not file the appended ORDER to my court filing and STRIKE the Unconstitutional Non-Precedential Decision dated 6-25-20 and ALL Appellees court filings that are conspiring against my rights then they are served with the appended the Violation Warning letter for Denial of Rights Under Color of Law to each judge on the panel and the prothonotary for filing the UNCONSTITUTIONAL Decision. I have repeatedly asked Senator Rubio, Congressman Rutherford, Governor DeSantis and Representative Kelly for a CONGRESSIONAL HEARING for the investigation and prosecution of ALL involved and if they choose to not uphold their sworn oath to the Constitution of the United States of America then to consider themselves served with the COLOR OF LAW WARNING LETTERS: Senator Rubio, Congressman Rutherford, Governor DeSantis and Representative Kelly.
 
Appellant's Notice of Appeal dated 9-7-20 was filed by me (Joe Myers) to the Supreme Court of Pennsylvania for the Court to STRIKE  ALL prior UNCONSTITUTIONAL Orders from the lower courts as well as ALL Appellees court filings that are conspiring against my rights.

Superior Court Letter-Order dated 9-1-20 sent to me (Joe Myers) from the Superior Court of Pennsylvania was not received by me until after I filed the Appellant's Notice of Appeal dated 9-7-20. The Superior Court of Pennsylvania continues to use RULES of the court to UNCONSTITUTIONALLY attempt to dismiss my case YET DOES NOT use the LAW that protects my CONSTITUTIONAL RIGHTS and that very ACT by the Superior Court of Pennsylvania is a CRIME and TREASON!

I informed him he SWORE an OATH to UPHOLD the CONSTITUTION and if he were in my shoes he would be upset it is taking 20 years to seek justice for the CRIMES committed against me!

Goldinger email to me regarding the U.S. Attorney for the Western District of Pennsylvania. I informed Goldinger I have contact that office and awaiting a reply. I also informed Goldinger that FRAUD has continued by ALL Appellees and he is has to investigate and prosecute all involved in the CONSPIRACY and CRIMES against me.

Email to Butler County District Attorney Goldinger dated 10-8-20 is an email I (Joe Myers) replied to Butler County District Attorney Richard A. Goldinger informing him that the U.S. Attorney for the Western District of Pennsylvania office called me today and stated when the FBI provides them the information regarding the crimes they will prosecute but in the meantime Goldinger must do his job as a state prosecutor and investigate and prosecute ALL Appellees involved in the CONSPIRACY and CRIMES against me.

Email to Butler County District Attorney Goldinger dated 10-9-20 is an email I (Joe Myers) received from Butler County District Attorney Richard A. Goldinger informing me that my emails have been forwarded to the Pennsylvania State Police for investigation.

Email to Governor DeSantis Senator Rubio and Congressman Rutherford dated 10-15-20 is an email I (Joe Myers) sent to Governor DeSantis and copied Senator Rubio and Congressman Rutherford after contacting the Governor's office and was informed by Staffer, Madison Nykamp, that their office had no record of any emails I had sent the Governor. In this email I attached the auto confirmation emails that the Governor did in fact receive my emails. Additionally in the email I provided a brief synopsis of the CRIMES committed  against me as well as provided the letter dated 2-20-20 (DOJ - FBI Response to Senator Rubio) that was sent from the U.S. Department of Justice to Senator Rubio for me to Contact the FBI Jacksonville Field Office. I also provided the letter dated 5-8-20 (FBI Letter) I sent the FBI Jacksonville Field Office after the FBI requested more information from me. In the email I also requested the Governor to contact the FBI on my behalf to apply the full weight of the Governor's office to bring the investigation and prosecution against ALL involved of CONSPIRING against my CONSTITUTIONAL GUARANTEED RIGHTS! Since this email Staffer, Chris Miller, from Congressman Rutherford's office spoke with me in a phone conversation. Chris Miller asked me to contact Steve Daugherty from the Jacksonville FBI office and give Steve the phone name and phone number for Chris so Steve can call and Chris can inform Steve that Congressman Rutherford is part of the Congressional Inquiry regarding the corruption perpetrated against me at the local, state and federal level.    

Petitioner's Notice of Appeal Addendum dated 11-7-20 is a  court filing I (Joe Myers) filed with the Supreme Court of Pennsylvania warning the court for violating U.S.C Title 50 Section 841:

“The Congress finds and declares that the Communist Party of the United States, although purportedly a political party, is in fact an instrumentality of a conspiracy to overthrow the Government of the United States. It constitutes an authoritarian dictatorship within a republic, demanding for itself the rights and privileges accorded to political parties, but denying to all others the liberties guaranteed by the Constitution.” (Emphasis added)

Petitioners Application for Permission to File 3-8-21 and Supreme Court Prothonotary letter 3-8-21 is a court filing I (Joe Myers) filed with the Supreme Court of Pennsylvania to add Respondents Butler County, Butler County District Attorney Richard A. Goldinger and Corporal Tim Morando for being part of the conspiracy to violate my Constitutional Rights. I provided the evidence that Respondent McCune refused when I contacted him when he was the District Attorney.
